3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
Bristol City Council and undertook a mini competition as a part of the EU compliant West of England Housing Delivery Framework in September 2015. United Communities partner Bristol Community Housing Foundation working with HAB Housing were selected by the Council as the preferred delivery partners. The Council is entering into a contract with Bristol Community Housing Foundation, HAB Housing Limited and a Special Purpose Vehicle called Dunmail 2017 to deliver this scheme, rather than United Communities and Bristol Community Housing Foundation alone. Alongside this change to the procurement process, we have also negotiated some amendments to the requirements in the model development agreement and Design Guide made available at the time of the mini-competition.
