in the Official Journal of the European Union
The contract has as its object services listed in Annex II B to the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Air Commodities Delivery Team (ACDT) part of the UK Ministry of Defence (“MoD”), intends to award a Contract to Finning (UK) Ltd for the In Service Support of Rough Terrain Fork Lifts (RTFL) for 4 years from 2024 to 2028. It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 32(2)(b)(ii) of Public Contracts Regulations 2015) for technical reasons. This is because Finning (UK) Ltd are the Design Organisation (DO) and sole authorised UK dealer for the Caterpillar Rough Terrain Forklifts (CAT RTFL). As such, they are the only supplier of approved Original Equipment Manufacturer (OEM) spares in the UK.
