The Dismounted Close Combat Programme Team, part of the UK Ministry of Defence, intends to place a contract with Ian Edgar (Liverpool) Limited, the sole UK agent for AIMLOCK USA which is the manufacturer for the capability to undertake baseline trials by the OEM to support the procurement decision by the Authority for the supply and support of a stabilised weapon system that meets the following Key requirements.
1. Shoulder fired stabilised system.
2. Man Portable.
3. Walk on walk off.
4. No adaptation of host platform.
5. AR15 Compatible
6. No mechanical interruption of shot release, direct release of shot through User action.

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI No.2019/697) this procurement shall be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 (DSPCR 2011) as amended (in particular by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate.
It is considered that this Contract can be placed using the Negotiated Procedure without Prior Publication of a Contract Notice in the UK e-notification service (as required by the relevant legislation) and is lawful in accordance with regulation 16(1)(a)(ii) of the DSPCR for technical reasons.
Following the responses to an RFI published 7 November 2022 and closed 30 November 2022 under procurement reference: 705780450 to determine if there are alternative solutions available in the market, AIMLOCK USA represented by their sole UK Agent Ian Edgar (Liverpool) Limited remained the only company that has a viable solution available that could potentially meet the Authority’s technical requirements.
