in the Official Journal of the European Union

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The UK Ministry of Defence intends to award an 18 month contract to KBR for the estimated value of £857,999 pursuant to the Public Contracts Regulations 2015 (PCR 2015) using the negotiated procedure without prior publication of a contract notice for the provision of a Iron Stallion software toolkit.  This procedure is considered justified for technical reasons under Regulation 32 (2)(b)(ii) of the PCR 2015. This particular toolset is required for interoperability reasons in support of a joint military objective with UK allies.  Without purchase of this particular system, the UK MOD will be unable to produce a combined operating picture with their military allies in support of their joint military objectives.
