3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Communications & Situational Awareness (CSA) Project Team within Defence Equipment & Support (DE&S), part of the UK Ministry of Defence, (“the Authority”) intends to award a Contract to Orolia SAS (France) (“the Contractor”) for the Supply and Repair of G2R and Sarbe 6 Personal Locator Beacons (PLBs). The Contract will extend the services currently provided to the Authority by the contractor for a further period of 1 year to 22nd March 2023. The value of the proposed contract is £744,166.67.
The purpose of the contract is for the provision of maintenance of the current PLBs through refurbishment of current stock and procurement of additional spares where required and not a full replacement of equipment.
In accordance with regulation 4 of The Defence and Security Public Contracts (Amendment) (EU Exit) Regulations 2019 (SI 2019/697) this procurement falls to be regulated under the provisions of the Defence and Security Public Contracts Regulations 2011 as amended (by SI 2019/697 and SI 2020/1450). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (in accordance with the relevant legislation) is lawful in accordance with regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 for technical reasons.
This is on the basis that Orolia SAS are the Original Equipment Manufacturer and retain the full system design, build and integration expertise and knowledge. Orolia SAS possess the relevant technical know-how and ownership of the brand, designs, drawings, and manufacturing data packs. The Contractor is the only company with access to this propriety information and the necessary knowledge, skills, and tools required to undertake repairs and the provision of spares to meet this requirement. The use of any other PLB in conjunction with the G2R would be incompatible. Sarbe is a registered Trademark owned by Orolia SAS
