Babcock Land Defence Ltd, acting as the Agent to the UK Ministry of Defence (MOD), intends to negotiate a single source contract with Ultra Electronics Holdings (UEH) for the repair, calibration and maintenance of Fuel System Test Sets (‘FSTS’) and related components, including cable sets. There will also be the provision for two 1-year options should this be required and subject to satisfactory supplier performance. The equipment supports a range of aircraft platforms.
At present the possible future requirement covers, but is not limited to: the repair, calibration and test of the following item and all associated cable sets.

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Babcock Land Defence Ltd, acting as the Agent to the UK Ministry of Defence (MOD), intends to negotiate a single source contract with Ultra Electronics Holdings (UEH) for the repair, calibration and maintenance of Fuel System Test Sets (‘FSTS’) and related components, including cable sets. The contract has an estimated value of GBP 515 000 for a duration of 5 years, with an additional two 1-year extension options; making the total duration a potential 7 years.
It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 (Article 28(1) (e) of Directive 2009/81/EC) for technical reasons.
The MOD do not hold repair specifications or baseline test procedures for the output specification of the equipment, therefore cannot create test procedures without this information. The FSTS is a safety critical piece of test equipment across multiple platforms, acceptance of specifications for reverse engineered repairs would be dependent on the ability to calibrate the equipment and provide suitable calibration procedures. Without knowing the upper and lower tolerance thresholds for calibration, the authority is unable to confirm that the calibration is within a tolerance sufficient to prevent equipment malfunction, or that the calibration is performed to the equivalent required UKAS standard. As MOD do not have access and cannot access the required information and nor would any other potential contractor, UEH are the only contractor that can fulfil this requirement.
