The Chemical, Biological, Radiological and Nuclear Delivery Team (CBRN DT) has a requirement to sustain Aircrew Protective Equipment for a period of 4-5 years commencing Jan 17.
The equipment is used by aircrew flying battlefield support helicopters, providing each crewman with a bespoke MAHIS (Military Aircrew Helmet Impact Standard) compliant flight helmet integrated to a Faceshield Respirator (FSR) and a Manside System (comprising a CBRN Air Filter, Blower, Battery and Battery Interface assemblies). This equipment provides the equipped aircrew with a CBRN respirator system integrated with, but operating independently of the aircraft’s systems.

II.2.4) Description of the procurement
Military helmets. The Chemical, Biological, Radiological and Nuclear Delivery Team (CBRN DT) has a future requirement to sustain Aircrew Protective Equipment for a period of 4-5 years commencing Jan 17.

The system was introduced into service in 2012 and equips 3 UK military formations, the current build standard was defined and frozen at the completion of the project’s assessment phase (Apr 2015). This contract is designed to maintain the availability of the system at this build standard.

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Defence Equipment and Support (‘DE&S’), Chemical, Biological, Radiological and Nuclear Delivery Team (‘CBRN DT’), which is part of the UK Ministry of Defence (the ‘MOD’), intends to award a contract to Crew Systems Corporation (the ‘Company’) for Aircrew Protective Equipment and Detection (APED) Above Neck System (ANS) In-Service Support (the ‘Contract’). The term of the Contract is 4 years with a 1 year option period.
It is considered that this contract may be entered into using the negotiated procedure without prior publication pursuant to Article 28(1)(a) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(i) of Defence and Security Public Contracts Regulations 2011) in the absence of suitable tenders in response to a restricted procedure conducted by the MOD. The MOD publicised its intention to seek offers in relation to the Contract in a contract notice published in the Official Journal on 22.1.2016 and issued its Invitation to Tender on 12.5.2016. The Company alone submitted a compliant tender, but its tender was not suitable on affordability grounds. The terms of the proposed Contract offered in the discontinued procedure have not been substantially altered in the negotiated procedure conducted under Article 28(1)(a) of Directive 2009/81/EC of the European Parliament and of the Council (Regulation 16(1)(a)(i) of Defence and Security Public Contracts Regulations 2011).
