3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
British Trust for Ornithology (BTO) has a unique relationship with a large network of skilled volunteers who collect the data for the existing BTO schemes: Breeding Bird Survey (BBS), Wetland Bird Survey (WeBS), Nest Record Scheme, Ringing Adults for Survival, Constant Effort Sites, and general ringing. The scheme would not be possible without these volunteers, many of whom are loyal members of the charity, familiar with the transect routes and methodology, and skilled in bird identification and handling.
BTO is the only supplier who can effectively mobilise their large network of volunteer bird recorders, which is essential to the successful running of the monitoring schemes. Whilst other Non Government Organisations may have large volunteer bases, BTO is the organisation with the largest volunteer base with skills and interest in recording birds. In addition, it is essential to the scheme to ensure continuity of the transects and sites that are already established in order to maintain scheme power and reduce bias caused by changing recorders. If coordination of transect recording was transferred to another organisation there would likely be issues with inconsistency of data collection, a very high risk of a reduction in sample size, and breaks in sampling of sites with a long data series. There would also be a substantial transition cost to build up a replacement network of volunteers.

The contracting authority considers that there are no alternatives and that the supply of services can only be meet by a particular operator as detailed above for the following reasons:- competition is absent for technical reasons, and the protection of exclusive rights, including intellectual property rights.

British Trust for Ornithology hold contact details of volunteer recorders which are protected under the Data Protection legislation, so there may be issues with sharing with an alternative operator.
