Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Training and Simulation Systems Programme Team (“TSSP”), part of the UK Ministry of Defence (“MOD”) intends to award an amendment to an existing contract with Cubic Defence Applications Inc for Post Design Services (PDS) Support for the Area Weapons Effects Simulator (AWES) to upgrade AWES equipment to resolve capability obsolescence.
It is considered that this amendment to contract can be placed using the Negotiated Procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of the Directive 2009/81/EC of the European Parliament and of The Council (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011.) Cubic Defence Applications Inc (CDA) is the manufacturer of, and Design Authority (DA) for AWES and presently holds the Support and Repair contract for AWES. The MoD cannot contract with any other economic entity as the performance of the PDS contract requires access to technical information including plans, designs and drawings owned by CDA and to which only it has access. Performance of the contract also requires access to ITAR controlled information and CDA is the only entity authorised to receive this information. For technical reasons and the necessity to use specific know-how and expertise the contract may only be awarded to CDA.”.
