Other justification for the award of the contract without prior publication of a call for competition
in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Warship Support Team (WSPT), within the Defence Equipment and Support (DE&S) which is part of the UK Ministry of Defence, intends to contract with Rolls Royce Plc for the provision of repair, overhaul and post overhaul testing to its WR-21 engines. It is considered that the contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC of the European Parliament and of the Council Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011.
The Authority owns a fleet of WR-21 engines which are installed in Type 45 vessels in service with the Royal Navy. The contract for their repair, overhaul and post overhaul testing can only be placed with Rolls Royce due to technical reasons. Rolls Royce is the Design Authority and manufacturer of the Engines and is the only economic operator with the necessary technical know-how, tooling and test equipment to carry out the contract. Proprietary information owned by Rolls Royce includes technical review data, production manuals, tooling design and drawings.
