is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Air Platform Systems Team, part of the Ministry of Defence, intends to amend Contract AVCOMM6/0048 — The Purchase of Combat Electromagnetic Environmental Simulator (CEESIM) and Extended Warranty in order to update the current systems to create reliable mission dependent data for defence. The CEESIM is a bespoke computer controlled Radar Simulator/Signal Generator that can produce highly complex Radio Frequency signals that replicate ‘real-life’ Radar Systems, for direct injection into aircraft Radar Warning Receiver Systems (RWRs) in a laboratory environment. The upgrade to the CEESIMs requires the introduction of new circuit boards and modification(s) of existing circuit cards that have been specifically designed and built by NGIT to their own exacting tolerances. It is considered that this contract amendment can be placed using the Negotiated Procedure without Prior Publication of a contract notice pursuant to Article 28(1)(e) of Direction 2009/81/EC (Regulation 16(1)(a)(ii)) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because Northrop Grumman International Trading Inc. (NGIT) is the original equipment manufacturer of the equipment and own proprietary technical data, including technical drawings and additional technical information such as circuit board tolerances relating to the CEESIM, which is required to enable this upgrade to the equipment.
