Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The UK Ministry of Defence, intends to award a contract to Ordnance Survey Ireland for the supply of maps and datasets for the Republic of Ireland. The term of the contract is 3 years (plus 2 12-month option periods) with a value of 172 590 GBP.
It is considered that this contract can be awarded using the Negotiated Procedure Without Prior Publication pursuant to Article 32 (2)(b)(iii) of Directive 2014/24/EU of the European Parliament and of the Council (Regulation 32 (2)(b)(iii) of the UK Public Contract Regulations 2015) for the protection of exclusive rights. This is because Ordnance Survey Ireland is a corporate body of the Government of Ireland which has the exclusive right to license the use of the country wide mapping data for commercial and GSI users.
