1) κάθε ενδιαφερόμενος οικονομικός φορέας, ο οποίος έχει ή είχε συμφέρον να του ανατεθεί η σύμβαση και ο οποίος υπέστη ή ενδέχεται να υποστεί ζημία από πράξη ή απόφαση της αναθέτουσας αρχής, που προηγείται της σύναψης της σύμβασης και για την οποία εικάζεται ότι παραβιάζει οποιαδήποτε διάταξη του ισχύοντος δικαίου, έχει δικαίωμα να προσφύγει στην Αναθεωρητική Αρχή Προσφορών, σύμφωνα με τις διατάξεις του Νόμου περί των Διαδικασιών Προσφυγής τον Τομέα της Σύναψης των Δημοσίων Συμβάσεων του 2010 (Ν.104(Ι)/2010)·
