3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Joint Electronic Surveillance Delivery Team, within the United Kingdom Ministry of Defence, intend to award a Contract to Steatite Limited for the delivery of an initial 25 MPU5 radios, ancillaries, spares, training, support, with options to procure additional systems (“the Contract”). The Contract has an anticipated value of £1.1M (ex VAT) and a total contract duration of 5 years, subject to option periods (3+1+1).
It is considered that this Contract can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(3)(a) of Directive 2009/81/EC and Regulation 16(1)(b)(i)(aa) of the Defence and Security Public Contracts Regulations 2011 for additional goods. The radios are required in addition to existing MPU5 radios. To obtain alternative radios from an alternative supplier would oblige MOD to acquire goods with different technical characteristics. This would result in incompatibility between the existing goods and failure to provide additional equipment capable of communicating with current in-service radios. MPU5 radios are essential in enabling a networking solution with the in-service radios.
