competition in the Official Journal of the European Union

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Babcock DSG Limited, acting as agent for the UK Ministry of Defence, intends to negotiate a contract with David Brown Gear Systems Limited (‘DBGS Limited’) for the repair and re manufacture of TN15E/E+ and TN54E/ETS gearboxes and associated assemblies, including the steer unit. It is considered that this contract can be awarded using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1) (e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. The UK Ministry of Defence requirement includes the remanufacturing of the TN15E/E+ and TN54E/ETS gearbox and associated assemblies, in accordance with the original equipment manufacturer specification, to A1 standard, including repair/remanufacture of a number of component parts and sub-assemblies. This is a safety critical requirement with integration risk arising from all repaired/remanufactured components and sub-assemblies being incorporated into and /or operating with the TN15E/E+ and TN54E/ETS gearbox in accordance with the original equipment manufacturer standards. The requirement involves pre-contractual testing.
DBGS Limited is the original equipment manufacturer and the proprietary owner of the design for the TN15E/E+ and TN54E/ETS gearboxes and holds the related design drawings/information and technical specifications, data and knowledge. Without access to such design drawings/information and technical specifications, data and knowledge, the UK Ministry of Defence is not in a position to be able to identify the exact technical requirements (including the original equipment manufacturer standards) which are required to ensure the safety and suitability of the requirement and that the overall transmission platform is not compromised. Neither are such technical requirements available to any other supplier. As a result, DBGS Limited is the only company with the technical expertise and know-how to undertake the services covered by the scope of this requirement.
This notice is not a request for expressions of interest so please do not apply to be invited to tender. Babcock is to negotiate a single source framework agreement with the named supplier.
