The works, supplies or services can be provided only by a particular economic operator for the following reason:

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Remotely Piloted Air Systems Team, part of the UK Ministry of Defence (“MoD”), intends to award a Contract to BAE Systems supporting both Protector and Watchkeeper Platforms. Both Teams currently use Trilogi Build software supplied by BAE, however, this package is uneditable and view only. Therefore, there is now a need for Trilogi Build+ licenses so that data can be edited. The contract duration is for 1 year from October 2023 until October 2024. It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(1) (e) of Directive 2009/81/EC (Regulation 16(1) (a) (ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons.
As Trilogi Build is currently being supplied by BAE, the procurement is for an uplift of those licenses. BAES own the IP for Trilogi Build.
