Justification for the award of the contract without prior publication of a call for
competition in the Official Journal of the European Union

The products involved are manufactured purely for the purpose of research , experiment, study or development under the conditions stated
in the directive(for supplies only)
The works, supplies or services can be provided only by a particular economic operator for the following reason:
absence of competition for technical reasons

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
British Forces Gibraltar, part of the Ministry of Defence, intends to enter into a contract with Gibtelecom Ltd for the supply of approximately 100 mobile SIMS for users based in Gibraltar, including calls and data packages. The contract will be for 3 years with a further two, 1 year options and have a value of approximately £230k.
In accordance with the provisions of The Public Procurement (Amendment etc.) (EU Exit) Regulations 2020 SI No. 2020/1319, this procurement falls to be regulated under the provisions of the Public Contracts Regulations 2015 as amended (in particular by SI 2020/1319). Prior publication of a contract notice in the Official Journal of the European Union is no longer appropriate. It is considered that the award of the contract without prior publication of a contract notice in the UK e-notification service (as required by in accordance with the relevant legislation) is lawful in accordance with regulation 32(b)(ii) of the PCR 2015 because competition is absent for technical reasons.
This is because Gibtelecom Ltd is the only supplier able to provide SIMS with a phone number with a Gibraltar International Dialling Code (+350), thereby allowing current numbers to be retained.
