in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive
3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Given the specialist nature of the requirement, that it is for emergency repairs, and the health & safety issues related to this, CITB want to proceed as soon as possible. It is a specialist roof (Plygene) and CITB have had the manufacturer complete a survey to establish the remedial works required. Due to the specialist nature of the repairs, the manufacturer identified 3 local contractors who are approved to work on this type of system. Out of the 3 suppliers contacted, one opted not to quote and the other failed to respond to CITB’s request for quote. Due to the time restraints, a full tender is not viable at present.
