is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contract Regulations 2011 for technical reasons.
Davall Gears Ltd is the OEM for this item and holds the exclusive rights to the design drawings, technical specifications and technical expertise (‘technical knowhow’) for the Hand Traverse Gearbox. Davall Gears is the OEM for this item and no other party has access to the information necessary to repair the item required by the UK Ministry of Defence.
