3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
Babcock Land Defence Limited, acting as agent for the UK Ministry of Defence, intends to negotiate a single source contract with Horstman Defence Systems Limited for Repair and Provision of Output Specifications for Heavy Platform Gas Charging Equipment.

Babcock intends to place a five (5) year contract which will include two (2) one (1) year extension options; making a maximum potential contract duration of seven (7) years.

It is considered that this Contract can be placed using the Negotiated procedure without prior publication pursuant to Regulation 16(1)(a)(ii) of the Defence and Security Public Contract Regulations 2011 (Article 28(1)(e) of the Directive 2009/81/EC) for technical reasons.
Horstman are the original equipment manufacturer (‘OEM’) for spares, components and testing necessary to effect repairs of the Gas Charging Kit and the Portable Universal Nitrogen Charging Kit (PUNCK).

As the Original Equipment Designer and Manufacturer of these Gas Charging Kits only Horstman have the technical information and data necessary to perform the requirement without introducing an unacceptable level of risk to operational safety in accordance with the PSSR 2000 Regulations and MOD operational requirements.

This notice is not for expressions of interest, therefore please do not apply to be invited to tender. The notice advises that the Authority has decided to negotiate a contract directly with Horstman Defence Systems Limited on a single source basis and is published for reasons of transparency only.
