3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The Special Projects Explosive Ordnance Disposal and Search (SPEOD&S) Delivery Team, as part of the UK Ministry of Defence (“MOD”), intends to award a contract to Terrafix Ltd for the In Service Support of the EOD Command, Control and Information System (C2IS) and Tracking system, named COMTRACK. It is considered that this contract shall be placed using the Negotiated Procedure without prior publication of a contract notice pursuant to Article 28 (1) (e) of the Directive 2009/81/EC (Regulation 16 (1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011). The supplier has previously designed and developed electronic architecture to meet the specific user requirement, not contracting with Terrafix Ltd would result in a complete rework of all electronic architecture resulting in high probability of failure to interoperate with Blue-light Response Specialists. Failure to interoperate would result in an unacceptable negative impact to MECA EOD operational capability.

The contract will provide on-going support to the COMTRACK system in the current WEDGEWOOD EOD vehicles. This contract will run from September 2019 – March 2020.
