Justification for the award of the contract without prior publication of a call for
competition in the Official Journal of the European Union
1.Justification for the choice of the negotiated procedure without prior publication of a call for competition in accordance with Article
32 of Directive 2014/24/EU
The works, supplies or services can be provided only by a particular economic operator for the following reason:
absence of competition for technical reasons

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
(a) the Authority needs to ensure that a replacement wide area network is provided without disruption to the operation of the existing wide area network that is vital to public safety. This is critical during the period where the Authority is in the process of a procuring a new command and control systems for the purpose of ensuring compliance with the future ESN requirements. Widespread replacement of existing access circuits, customer premises equipment and IP addressing at this time would present an unacceptable risk to operations;
(b)the Authority needs to ensure seamless sharing of Virgin Media Business circuits with the Bedfordshire, Cambridgeshire and Hertfordshire (BCH) Police which will be required to deliver site sharing and optimise co-working in the Authority areas;
(c)the Authority needs to ensure that it procures a wide area network that will be fully operational at the time the financial commitment to its existing contract for such provision ends on 31.6.2019.
