in the Official Journal of the European Union
The procurement falls outside the scope of application of the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Award of a contract without prior publication of a call for competition in the Official Journal of the European Union as per PCR2015 Pt. 2 Ch.2 Sec.3 Reg. 32b ii) – competition is absent for technical reasons. The UK government has mandated that Bath and North East Somerset Council improves the air quality in the City of Bath and its surrounding areas under the Environmental Act 1995 National Air Quality Plan for Nitrogen Dioxide. The Council must therefore procure appropriate traffic monitoring cameras. The Council tendered for Automatic Number Plate Recognition Cameras in 2017 (OJEU Notice 2017/S 050-092053 dated 10.3.2017). The Council intends to procure the additional cameras and maintenance without undertaking a new procurement exercise. There must be technical continuity between the new enforcement cameras and existing equipment and back office software applications providing full and seamless technical integration. Once the final plan is agreed and approved by the government, the Council is required to ensure compliance in the shortest possible time. It is likely that the equipment will need to be in place and functioning by Spring 2020. Funding for the National Air Quality Plan is from the UK Government.
