in the Official Journal of the European Union
The contract has as its object services listed in Annex II B to the directive

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Air Intelligence Surveillance Targeting Acquisition and Reconnaissance (ISTAR) Force currently consists of 5 Aircraft Platform Types. Across these Aircraft Types issues have been experienced over recent years that continue to result in capability issues, most notably relating to the availability of mission capable aircraft.
The need to urgently address current availability issues across the Air ISTAR fleets and initiate a transformation programme is a matter of priority due to the impact on the department’s ability to deliver support to operations as well as its NATO commitments. This will be done through placing a 9 month contract from April 2017, for Consultancy Advice on; availability improvement measures, recommendations for improving coherence across the AirISTAR enterprise, establishing a governance structure for Programme ATHENA and establishing the scope and plan for the next phase of Programme ATHENA, this will include the technical elements of any future competition for Consultancy Advice for Programme ATHENA.
It is intended that this nine month contract will be placed with Qi Results (58 Shoreview, Hampton Hargate, Peterborough, Cambs. PE7 8FS — 01733 311979) using the Negotiated Procedure without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons.
Key elements of the scope of the Contract will draw and build upon work Qi Results has successfully completed under sub-contract arrangements with Air ISTAR Prime Contractors to identify and implement measures for improving the performance of support solutions. As a consequence, Qi Results has developed an intimate knowledge of the Air ISTAR platforms, the associated support solutions and supply chains, and the range of disparate operating models that collectively deliver the Air ISTAR force elements of readiness. Only Qi Results has the necessary background knowledge, experience and information that is essential to developing and implementing rapid solutions to current availability issues whilst also establishing the mandate and strategy for Programme Athena within the required timescales.
The scope of the nine month Contractwill include defining the requirements for any longer-term Consultancy Advice support for Programme Athena, which will be acquired through competition.
