Short description of the contract or purchase(s): The provision of a design service for BOWMAN, ComBAT, Infrastructure and Platform (BCIP) and Land Environment Tactical Communications Information Systems equipment (LE TacCIS). This is to include but is not limited to post design services, system safety, obsolescence management, information management and maintenance of system design and architecture. This is estimated as a category B1 requirement with a firm contract duration of 5 years, with option to extend for a further 1 year contract.

Reason for Award: BCIP is a complex configuration containing many items of equipment from numerous OEMs linked together by General Dynamics United Kingdom as a System Integrator to create an adaptive tactical network. It is anticipated that the service will provide, but is not limited to, post design services, system safety and obsolescence management. The service will also provide for information management and maintenance of system design and architecture. The service will replace the current Design Services Provision provided by General Dynamics UK Ltd (GDUK).

Justification For Non-Competitive Decision: For technical reasons, the services can only be placed with GDUK by virtue of their specific technical know-how. The expertise and unique knowledge necessary to undertake this PDS and technical support contract lies with GDUK, because they have developed, supported and operated the equipment since its development. The Authority considers that such capabilities, skills and processes could not be replicated by any other party and could introduce unacceptable suspensions to a crucial capability. No other company has the experience or knowledge of this very complex system sufficient to ensure continued effective support, interruption of which could produce significant risk to both safety and operability. This contract is exempt from the Defence and Secuirty Public Contracts Regulations 2011 (“DSPCR”) pursuant to Regulation 7(1)(a) and Article 346(1)(a) of the Treaty on the Functioning of the European Union for protection of the essential security interests of the UK. The obligations, rights and remedies under the DSPCR therefore do not apply to this procurement.
