Reason for Award: To supply S2170 Test & Trial EADs
Justification For Non-Competitive Decision: Maritime Combat Systems, part of the UK Ministry of Defence intends to award a one year contract to Ultra Electronics Limited Sonar & Communications Systems to supply modified Ship Surface Torpedo Defence Explosive Acoustic Devices (EADs). It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. The EADs form a critical part of a system which is currently in operation and only these particular EADs can be used within that system. Neither these items nor spare parts for them can be obtained from any party other than Ultra Electronics Limited Sonar & Communications Systems. Furthermore, only Ultra Electronics Limited has the information necessary to manufacture the EAD.
The SSTD EAD is a bespoke device designed to work within the SSTD system, the EAD being an Ultra Proprietary Item cannot be supplied by anyone else and as we do not have any rights to their EAD design information. Accordingly there would be technical & safety concerns with a third party manufacturing the units, as we would have no technical information to provide to them. There are also no other suppliers of this or similar countermeasures to offer as an alternative. Currently no opportunities exist to redesign or redevelop the EAD Countermeasure and any redesign by an alternative supplier would require significant new development and new manufacture costs. This would only become a feasible option, if there was a change to the complete SSTD System and none are anticipated in the next 5 years.
