II.1.4) Short Description: The road pavement on sections of the road of state importance M-05 Kyiv – Odesa has lost its bearing capacity because of delayed repairs and increasing axle load of vehicles. The asphalt pavement has numerous ruts, potholes, cracks and destruction of the edge of the pavement. The project is aimed at capital repair of M05 road sections in Cherkassy Region and is planned in three lots: Lot 1, km 152+918 – km 191+278; Lot 2, km 191+278 – km 214+693; Lot 3, km 214+693 – km 237+108. Project implementation will allow for reliable and comfortable driving conditions, according to the forecast intensity of traffic, while addressing also traffic safety related deficiencies along the abovementioned sections of the road.

II.2.4) Description of the procurement:
The State Road Agency of Ukraine (“Employer”) intends to use part of the proceeds of a loan from the European Bank for Reconstruction and Development (“EBRD”) and the European Investment Bank (“EIB”) (together the Banks) towards the cost of Ukraine Road Corridors / European Roads Ukraine III Project
The Promoter now intends to select and contract a construction company (the Contractor) to the Assignment, on the basis of the Prequalification Documents.
The procurement will be conducted following the applicable guidelines: the EBRD’s Procurement Policies and Rules.
Contractors Selection Procedure: Single stage open tendering (works)
The selection will normally be made from the Proposals received in response to this notification only, based on the selection criteria set out in the TD.
– Prequalification Documents are free of charge;
– Time for Completion
o Lot 1: 730 days (24 months)
– Defects Notification Period
o Lot 1: 365 days (12 months)
– Eligibility: Firms originating from all countries of the world are eligible to tender for works, goods and services contracts;
– Grounds for Exclusion:
o Conflict of Interest;
o Prohibited Conduct;
o Debarment lists;
o EU sanctions;
o National embargos;
o Violation of IP rights
– The Participant shall meet the minimum criteria for general, management and specific experience for the time period stated in Section IV, Eligibility and Qualification Criteria.
o General Experience as a contractor (in any role), in the execution of at least 3 (three) contracts, each with a value of works, implemented by the Participant, at least:
3 (three) contracts:
• Lot 1: EUR 80 000 000 each contract;
– The Participant shall own, or have assured access to (through hire, lease, purchase agreement, availability of manufacturing equipment, or other means) the key items of equipment, listed in Section IV, Eligibility and Qualification Criteria, being in full working order, and must demonstrate that they will be available for use in the contract.
– The Participant shall provide audited balance sheets, or if not required by the law of the Participant’s country, other financial statements acceptable to the Promoter for the period from 2016 till 2020.
– The Participant shall demonstrate minimum average annual turnover:
o Lot 1: EUR 125 000 000 equivalent.
