Justification for the award of the contract without prior publication of a call for
competition in the Official Journal of the European Union
1.Justification for the choice of the negotiated procedure without publication of a call for competition in accordance with
Article 28 of Directive 2009/81/EU
The works, supplies or services can be provided only by a particular economic operator for the following reason:
absence of competition for technical reasons

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
Babcock Land Defence Ltd , acting as agent for the United Kingdom Ministry of Defence, intends to negotiate a new single source contract with ZF Services UK Ltd (ZF) for the repair of AS90 Howitzer (AS90) transmissions, drives and associated items.
Babcock intend to place a 5-year contract with a further 2 x 1 unfunded option years to provide an enduring contract.
It is considered that this contract will be let using the negotiated procedure without prior publication of a contract notice in accordance with Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011 (Article 28(1)(e) of Directive 2009/81/EC) for technical reasons.
AS90 transmissions, drives and associated items are specifically configured for the AS90 platform and military operational environment end use.
As the original equipment manufacturer of the AS90 transmissions, drives and associated items, only ZF have the technical information and data necessary to perform the requirement without introducing an unacceptable level of risk to operational safety and MOD operational requirements.
This notice is not for expressions of interest, therefore please do not apply to be invited to tender. The notice advises that the authority has decided to negotiate a contract directly with ZF Services UK Ltd on a single source basis and is published for reasons of transparency only.
