The UK Ministry of Defence (UK MOD) has previously issued a Pre-Procurement Notice (PPN) in February 2018 for the Market Engagement phase for the future of Maritime Support (including a Market Day and Request for Information) and a subsequent Prior Information Notice (PIN) issued in July 2018 advertising a second Market Day.

UK MOD issued a Contract Notice on 3rd October 2018 for combined Hard and Soft Facilities Management at Portsmouth. UK MOD is now amending this MOD Contract Notice (CN) to advertise the requirement for the Hard Facilities Management only at Portsmouth (Estimated value: Category A: £400M and above), as part of the Future Maritime Support Programme (FMSP). A new, separate, Defence Contract Notice will be issued for Soft Facilities Management only at Portsmouth.

Potential Providers are invited to express their interest in this procurement by 12 Noon on 28th November 2018, through the submission of a Pre-Qualification Questionnaire (PQQ) including execution of a Competition Process Agreement.

The scope of the Hard Facilities Management & Alongside Services (FMSP/008) at Portsmouth comprises on the following services:
• Infrastructure and Estates Services – Strategic Estates Management; Repair and Maintenance of Infrastructure; Utilities Management (including Building and Vessel Utilities); Design and Build New Infrastructure; Underwater Services; Estates Information Knowledge Management/Technology Information Centre.
• Berthing Services – Lifting Service; Rigging; Berthing and Unberthing of vessels alongside.

The supplier will provide Hard Facilities Management services to meet the requirements of the Authority at Portsmouth Naval Base.

The supplier will work closely with other FMSP suppliers to plan and execute Hard Facilities Management activity collectively and successfully.

The Authority has conducted a review of the requirements and determined that Contractors may be required to handle and protect UK EYES ONLY (UKEO) National Caveated information or assets and they must not permit anyone who is not a UK National to access such information or assets. Information identified as UKEO must not be sent to foreign governments, overseas contractors, international organisations or released to any foreign nationals (either overseas or in the UK) without the originator‘s specific consent. Due to this requirement, the Authority is proceeding with the procurement process in reliance on the exemption in the Treaty of the Functioning of the European Union (TFEU) set out in Article 346(1)(a) and the general exclusion from the Defence and Security Public Contract Regulations 2011 under Regulation 7(1)(a).

While the obligations, rights and remedies deriving from the DSPCR do not apply to this procurement, and nor is the procurement subject to the general EU law “Treaty Principles” which generally apply to public procurement procedures (as derived from the TFEU and/or the Treaty on European Union), the Authority does intend to follow a competitive procedure involving negotiation with bidders, with the objective of obtaining a value for money outcome.

The Authority reserves the right to:
i) amend the procurement timeline at its sole discretion
ii) withdraw this notice at any time for any reason.
iii) not to award any contract to any tenderer. The Authority does not bind itself to enter into any contract(s) arising out of the proceedings envisaged by this contract notice and no contractual rights express or implied arising out of this contract notice or the procedures envisaged by it.

Potential Providers who respond to this procurement are responsible for their costs and expenses incurred in connection with the preparation and submission of the PQQ and all future stages of the selection and tender process. Neither the Authority, nor any of its advisers, accepts any liability in respect of this PQQ or any supporting documentation or liability for any costs or expenses borne by the Potential Provider or any of their Sub-Contractors or advisers in this process.

The Authority has engaged Commerce Decisions Limited to run the Competition Site (AWARD®) to support the PQQ process. The Competition Site is available as an internet-based portal, providing access to relevant information controlled via login and permissions. Operating instructions for the Competition Site are available on the Competition Site once login and permissions are issued. Potential Provider Entities must have self-registered on the Competition Site, through the open registration process to access the PQQ documents.

Full AWARD® Software operating instructions are available within the tool once login and permissions are issued. The dates given assume an anticipated start date. The minimum contract duration will be 3 years, the maximum will be 5 years, both with an option to extend for up to 2 years. Any option(s) to extend will be exercised solely at MODs discretion.
