(i) The tender is sought for an independent advocacy service for adults which provides all aspects of service provision relating to statutory advocacy within the service specification.
Statutory provision comprises of advocates in the following areas:
— Independent Mental Health Advocacy (IMHA): supporting people who have been detained under the 1983 Mental Health Act to understand their rights,
— Independent Mental Capacity Advocacy (IMCA): provided when:
—— the person is aged 16 or over,
—— a decision needs to be made about either a long-term change in accommodation or a serious medical treatment,
—— the person lacks capacity to make that decision,
—— there is no one independent of services, such as a family member or friend, who is “appropriate to consult”.
— Care Act Advocacy – requirement under the Care Act for customers to be involved in the decision making process. If client needs support to do this then an appropriate Individual will be appointed to support them,
— NHS Complaints Advocacy – supporting adults to make a complaint about the NHS in regards to the treatment they have received.
Non statutory advocacy is to be promoted though signposting and fully utilising the existing 3rd sector Providers. Non statutory will include attendance at client groups, voice groups and executive boards for client groups such as learning disabilities.
The maximum budget for Adults service is 225 000 GBP (two hundred and twenty-five thousand pounds only).
