Short description of the contract or purchase(s): The Air Commodities Team, part of the UK Ministry of Defence (“the Authority”) intends to extend the existing In-Service Support arrangement for Airside Passenger Busses with Terberg DTS (UK).
It is considered in accordance with Article 2014/24/EU of the European Parliament and of the Council (Regulation 72(1)(b)(i)(ii) of the Public Contracts Regulations 2015), that continuation of support can be placed with Terberg DTS (UK) using the negotiated procedure without prior publication of a contract notice. This is due to Terberg DTS (UK) being the original equipment manufacturer (OEM) for the tooling required for maintenance and repair of the vehicles, of which OPTARE are the OEM. Terberg sub-contracted OPTARE to specifically design a Commercial off The Shelf (COTS) vehicle to operate at an RAF Airfield. The current three (3) Airside Passenger Buses are the only three made and supported to this specification and Terberg DTS (UK) hold the specialist tooling required to maintain the vehicles with the relevant trained personnel to carry out necessary repair and maintenance holding appropriate spares packages.
Configuration control has been maintained by Terberg DTS (UK) throughout the life of the vehicles and therefore moving to a new supplier at this stage could introduce technical and interoperability issues.

This notice advises that the Authority has decided to negotiate a contract with the named supplier on a single source basis, and is published for reasons of transparency.
