Short description of the contract or purchase(s): The Marine Systems Support Output Business Unit (MSS), within the Defence Equipment and Support organisation (DE&S) which is part of the UK Ministry of Defence (MoD), intends to place a contract for: “In-service support of Naval Valves of Hale Hamilton manufacture”.

The contract scope will cover Post Design Services, Repairs & Overhaul, and Spares Supply for First Level & Non-First Level Fluid Valves, Pressure Reducing Stations, Submarine Escape Equipment, Auto Charging Facility (ACF) and Breathing Air Panels fitted on HM Ships and Submarines, with Hale Hamilton Valves Ltd for a period of 5 years.

It is considered that this requirement can be placed using the negotiated procedure without prior publication pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons and for reasons connected with the protection of exclusive rights, only with Hale Hamilton Valves Limited.

Hale Hamilton Valves Ltd are the Original Equipment Manufacturer and hold Intellectual Property for the equipment in respect of designs, production processes, overhaul specifications and associated repair test schedules, and these are not available to an alternative supplier.

The Contract is for support of equipment for which there is known to be no functional equivalent on the market. The equipment has been subject to extensive testing to prove characteristics such as shock tolerance, magnetic susceptibility and reliability. A substitute product would require modification of the surrounding system or to the equipment itself and a corresponding qualification programme which would introduce unacceptable risks to the systems availability due to unavailability of access to platforms and equipment for system integration, validation, verification and qualification (IVVQ).

The technical information held by Hale Hamilton is necessary for performing this requirement to the safety levels required by the mandatory Safety of Life at Sea requirements. Failure to use HH would lead to significant safety issues due to denial of access to technical information of HH manufactured items by third parties which could lead to significant hazard to health and equipment, which are unacceptable to the Authority.
