II.2.4) Description of the procurement
The United Kingdom Ministry of Defence (the “Authority”) intends to place a contract with Kelvin Hughes Ltd (the “Company”) for the In-Service Support of Radar 1007/1009, to include the provision of Engineering Support and the Supply of Spares and Repairs. Radar 1007/1009 is fitted to a range of Royal Navy and Royal Fleet Auxiliary Platforms.
It is considered that this contract can be placed using the Negotiated Procedure Without Prior Publication pursuant to Article 28(1)(e) of Directive 2009/81/EC and Section 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011 (SI 1848) on the basis that the contract may be awarded only to the Company for technical and safety related reasons. The Company alone has at its disposal the Specialist Knowledge, Design and Manufacturing Documentation and Field Service Expertise built up since the introduction of Radar 1007 to the RN/RFA in 1986 and Radar 1009 to the RN/RFA in 2003

is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
