Reason for Award: The C17 Command Support Airborne Equipment Project Team (C17CSAE PT) as part of the UK Ministry of Defence (MOD) has a requirement for the provision of Through Life Support activities for the modified Medium-weight Stressed Platform (MSP), to include design organisation technical advice and provision of spares.
It is intended to award an amendment to Contract C17CSAE/0017 with Airborne Systems Limited (ASL) in order to increase the emergent work Limit of Liability by the value of £321,000. This will allow for the continuation of support services for the remaining contract duration until July 2018.
Justification For Non-Competitive Decision: It is considered that this Amendment can be placed using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) for technical reasons.
This is because ASL are the Original Equipment Manufacturer (OEM), and have extensive design knowledge of the equipment. Only ASL hold the technical information relating to safety mechanisms on the equipment which ensure the safe functioning of the Armed Forces.
For these reasons, the specialist skills, know-how and technical information required to support the MSP would not be available from an alternative supplier.
