3. Explanation

Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
This is a requirement for a tasking support arrangement. This will include obsolescence reporting, obsolescence upgrades for, GRiD 1595i workstations, Software and Peripheries to be placed with GriD Defence Systems Limited. It is considered that the contract can be placed using the negotiated procedure without prior publication pursuant to in Article 28(1)(e) Directive 2009/81/EC (Regulation 16(1)(a)(ii) of UK Defence and Security Public Contracts Regulations 2011. GRiD Defence Systems Limited is the original supplier of the Workstations and a change of supplier would oblige the MoD to acquire material having different technical characteristics which would result in incompatibility both with the workstations covered by the original contracts and software which has subsequently been developed to operate on the Workstations. The Contract will be for a period of less than 5 years.
