3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The Air Defence Electronic Warfare Team (ADEWS), part of the UK Ministry of Defence, intends to award a three year contract to Computer Application Services Ltd (the “Supplier”) for the Industrial Support and Maintenance of the Spadeadam Integrated Command, Control and Communication System (“SPICCCS”). It is considered that this contract can be placed using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (and Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) on the basis that for technical reasons the contract may be awarded only to the Supplier. The Supplier alone owns all of the copyright and all other intellectual property rights in the underlying software and system related documentation and has the technical skills necessary to meet the Authority’s technical requirements, the contract and accordingly no other supplier is able to perform the services, under the contract.
