Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The Vehicle Support Team — Armoured Tracks Portfolio (VST-ATP) part of the UK Ministry of Defence, intends to award a 3 year Contract to BAE Systems Hägglunds to provide Post Design Services for the Viking vehicle (7 variants), BV206 vehicle (14 variants), and Beach Recovery Vehicle (BRV). It is considered that this Contract can be placed using the Negotiated Procedure without prior publication pursuant to Article 28(1) of Directive 2009/81/EC of the European Parliament and of the Council under Regulation 16(1)(a)(ii) for technical reasons.
BAES Systems Hägglunds has access to the design and technical information of these complex articulated vehicles, which operate in both the amphibious and all terrain environment that fulfil the UK Forces Littoral platforms Amphibious Assault capability. The company has a sufficiently detailed understanding of the extreme operational environment requirements of these Vehicles designs and variants, and their historical configuration to undertake the Post Design Services. The design and technical coupled with the historical Post Design Services delivers the UK Forces coherent safety assurance.
