Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The ADEWS DT (Air Defence and Electronic Warfare Systems Delivery Team), part of the UK Ministry of Defence, intends to award a contract to BAE SYSTEMS (OPERATIONS) LTD for Primary Radar Feed from Warton Airfield. The estimated contract value is £300,000.

It is considered that this contract can be placed using the negotiated procedure without prior publication as permitted by article 32 of Directive 2014/24/EU regulation 32(b)(ii) of the UK Public Contracts Regulations 2015 for technical reasons.

BAE SYSTEMS (OPERATIONS) LTD is the only airport to cover the specific geographical area required to deliver these critical services in the region. Additionally, BAE SYSTEMS (OPERATIONS) LTD is the only supplier in the region with operational equipment to provide the feed in the required format and expertise to interface with the Authority’s subcontractors’ equipment/teams enabling the services to be delivered to the U.K. Air Surveillance and Control System.
