Reason for Award: Continuing requirement to support subject equipment whilst it remains in service with UK Armed Forces

Justification For Non-Competitive Decision: The Air Platform Systems (?APS?) Platform Protection team, part of the UK Ministry of Defence (?MOD?), intends to award a contract to Petards Joyce-Loebl Ltd for the through life support of ALE47 and M147 Countermeasure Dispensing Systems (?CMDS?) which are fitted to Lynx, Puma, Chinook Merlin, Shadow and C130J aircraft platforms.
It is considered that this contract can be awarded using the Negotiated Procedure Without Prior Publication of a Contract Notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons and for reasons connected with the protection of exclusive rights that subsist in the software and equipment.
This is because the ALE47 and M147 CDMS contains essential software and source codes that are proprietary and the necessary rights have not been assigned to the MOD or any third party. In addition, Petard Joyce-Loebl Ltd is the only economic operator with the technical know-how and expertise to fulfil the requirement.
