Reason for Award: Maritime Combat Systems are required by Navy Command to progress the Surface Common Combat System Version 2 (SCCS v2) project to advance the capability of the existing SCCS v1 infrastructure currently fitted to the T23 Platform.

Justification For Non-Competitive Decision: The Maritime Combat Systems Team, part of the UK Ministry of Defence, intends to award a 7 month amendment to the existing MCS/0011 contract to BAE Systems for Surface Common Combat System Version 2 (SCCS v2). It is considered that this Contract can be awarded using the negotiated procedure without prior publication of a contract notice pursuant to Article 28(1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the Defence and Security Public Contracts Regulations 2011) for technical reasons. This is because implementing SCCS v2 requirement onto the SCCS v1 system is technically complex and a safety critical activity, which must result in the on-going delivery of DNA(2) Command Management System performance. As the Original Equipment Manufacturer (OEM) of both SCCS and DNA(2), BAE Systems have the required expert knowledge and Suitably Qualified and Experienced Persons (SQEPs). SCCS v2 represents a key architectural change to the system, it was considered essential that all these criteria were met to ensure DNA(2) functions are successfully re-established with the new SCCS v2 system manager software thereby gaining full assurance of safe operation. Incorrect implementation of the changes increases the risk of safety critical incidents arising when operating the T23 Combat System. BAE Systems are the only organisation with the required level of control over the application, infrastructure and SQEP to ensure the successful delivery of a new system manager, and to provide assurance for it to work effectively with DNA(2) Command System.
