Justification for the award of the contract without prior publication of a call for

32 of Directive 2014/24/EU
The works, supplies or services can be provided only by a particular economic operator for the following reason:
absence of competition for technical reasons

3.Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union
is lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive:
The British Forces have an Alpine Training Centre based in Bavaria, Germany. They have a requirement to use 3 different ski resort areas in the Allgaeu region of Germany. This is in order to meet the required level of geographical proximity to the Alpine Training Centre; provide the required variety of slopes for training personnel with a range of experience and expertise; and to provide the required levels of capacity and back up. There are only 3 ski resorts which meet the authority’s requirements:
(1) Oberjoch/Unterjoch area;
(2) Hoernerbahn, Ofterschwang area;
(3) Nebelhorn/Fellhorn area.
The authority intends on placing 3 separate contracts directly with the economic operators who exclusively sell the ski lift tickets to use the different slopes for a period of 3 years with an additional 2 option years, or parts thereof.
The contracts will be as follows:
700027298 for Oberjoch — with Bergbahnen Hindelang-Oberjoch AG, estimated value 271 272,69 EUR .
700027299 for Höernerbahn, Ofterschwang — with Ofterschwang-Gunzesried GmbH and Co KG, estimated value 148 805,99 EUR
700027300 for Nebelhorn/Fellhorn — with Fellhornbahn GmbH, estimated value 687 412,08 EUR.
The authority intends to award the above contracts without prior publication in accordance with Regulation 32(2)(b)(ii) of the Public Contracts Regulations 2015 because, due to the technical reasons outlined above, competition is absent.
