Short description of the contract or purchase(s): DE&S Commercially Supported Shipping, Salvage & Marine Operations which is part of the UK Ministry of Defence (MOD), intends to place a two-week contract with Cwaves Limited (Company Registration Number 05417937) (the “Company”) for a survey of the wreck of the WWII tanker RFA WAR MEHTAR located 15NM east of Great Yarmouth (the Contract). The Contract has an estimated value of £400,000 (four-hundred thousand pounds sterling). The wreck is leaking oil and an assessment to evaluate the degree of risk posed and to determine future management options is urgently required

Justification For Non-Competitive Decision: It is considered that the Contract can be entered into using the negotiated procedure without prior publication of a contract notice pursuant to Article 32(2)(c) of Directive 2014/24/EU (Regulation 32(2)(c) of the Public Contracts Regulations 2015). The placing of the Contract is an extremely urgent requirement because of the acute environmental risk posed by the oil leaking from RFA WAR MEHTAR and the need to gain an accurate assessment of the situation and the options for future management. It is critical that the work is carried out before the onset of winter conditions increase the risk of disturbance to the wreck and make operating conditions at the site impracticable. Consequently, there is insufficient time in which to run a formal competition under EU procurement regulations in order to meet the operational timescales.
