3. Explanation
Please explain in a clear and comprehensive manner why the award of the contract without prior publication in the Official Journal of the European Union is
lawful, by stating the relevant facts and, as appropriate, the conclusions of law in accordance with the directive: (500 words maximum)
The Special Projects Search and Counter measures Team (SPSCM), as part of the UK Ministry of Defence (“MOD”) intends to award a contract to SDS Group Ltd, ETV £1M for the In Service Support (ISS) of the Computed Radiography Systems X-Ray Generators, Real Time Systems and Film Processors. It is considered that this contract can be placed using the Negotiated Procedure without prior publication of a contract notice pursuant to Article 28(1)(a) of Directive 2009/81/EC (Regulation 16(1)(a)(i) of the UK Defence and Security Public Contracts Regulations 2011) and Article 28 (1)(e) of Directive 2009/81/EC (Regulation 16(1)(a)(ii) of the UK Defence and Security Public Contracts Regulations 2011) consecutively.
A Contract Notice and DPQQ were published (Tender No.: 432838-2016) to seek a single potential ISS provider for the Sponsor’s DEOS suite of Radiography systems; two responses were received of which SDS Group Ltd was one. Both potential bidders tendered only to support their own equipment and therefore failed to reach the minimum pass rate on technical knowledge grounds.
To re-advertise the requirement with a revised scope would weaken the required ISS levels vital to maintain the capabilities. To retain the specific know-how and technical expertise required to maintain the X-Ray Generators, Real Time Systems and Film Processors the contract must be awarded to a particular economic operator proficient in this field. If the contract was performed by an inexperienced third party then any modifications or repairs to the systems would need to be supported by completely new Technical Data Pack at considerable time and expense
As the market testing failed to generate the required response to provide a Prime Contractor to manage the ISS for the Authority’s Computed Radiography equipment, it is therefore considered that the only remaining Procurement route is to place a Single Source contract with the respective equipment OEM.
